Terms of Service

This text is a starting draft. Fields in brackets are placeholders the business must fill in (and have the content reviewed by a legal advisor) before publishing it.
These terms govern the booking, through the Camino Backpack website, of the backpack transport service between accommodations on the Camino de Santiago. Making a booking implies full acceptance of these terms.
1. Purpose of the service
Camino Backpack provides an intermediation service: it manages the booking and payment for backpack transport between the accommodations indicated by the user for each stage. The physical transport is carried out by Correos through its Paq Mochila service; Camino Backpack does not transport backpacks directly.
2. Available routes
The service covers the Caminos and sections published on the website at the time of booking, between the origin and destination towns the user selects within each one. In low season (from 1 November to 15 March) Correos only provides the service on some sections, which the website indicates when booking.
3. Preparing and identifying the backpack
The user must hand over the backpack closed, in a condition that withstands transport, and correctly identified with the booking's label (a single one for the whole route), provided when the payment is confirmed and in the booking management portal. Camino Backpack and Correos are not responsible for loose items, unidentified items or items handed over outside the backpack.
4. Weight and dimensions
The limit is 15 kg and 56 x 40 x 25 cm per backpack, under the current terms of the Correos Paq Mochila service. Backpacks exceeding this limit may be refused at the pickup point.
5. Pickup and delivery times
The backpack must be ready at the reception of the origin accommodation by 8:00 am. Delivery at the destination accommodation takes place the same day, before 3:00 pm, under the current terms of the Correos Paq Mochila service.
6. Changes and rest days
Using the booking code and the email used to book, the user can view their itinerary on the booking management page. Until 8:00 pm (Spain time) the day before each pickup, the user can change the destination accommodation of the next stage or turn it into a rest day. After that deadline, that stage and all earlier ones are locked and can no longer be changed.
7. Cancellations
You can cancel your booking from the management portal until 8pm (Spain time) the day before the trip's start date, and you'll receive a full refund of the amount paid to your original payment method. After that deadline, or once transport has started, cancellations and refunds are not accepted. If you only need to make changes to your itinerary (not cancel it), you can change the destination accommodation of a stage or turn it into a rest day as described in the previous point.
8. Excluded items
The backpack must not contain valuables (cash, jewellery, high-value electronics), original identity documents, medication the user needs during the stage, fragile or perishable items, or dangerous, flammable materials or items whose transport is restricted under Correos regulations.
9. Price and payment method
The price is calculated per movement stage and per backpack, according to the rate in force at the time of booking, and is shown in full before payment. Payment is made by card or other payment methods enabled through the Stripe payment gateway when confirming the booking. All prices include VAT. Each payment comes with a simplified invoice or, if the user requests it —mandatory for amounts over €400—, a full invoice with their tax details; both can be viewed and printed in the booking management portal, and each refund comes with its corrective invoice.
10. Liability
Physical transport and its coverage for loss or damage are governed by the terms of the Correos Paq Mochila service. The indemnity is a fixed amount per loss or damage, set out in the contract between Camino Backpack and Correos. To process a claim, Correos reserves the right to recover the backpack for inspection and assessment, so the user must keep it available until the claim is fully resolved. Camino Backpack, as an intermediary, does not assume liability beyond that of Correos as the carrier.
11. Claims
Any incident (loss, damage or delay) must be reported to Camino Backpack within [X] hours of the expected delivery time, at info@caminobackpack.com, providing the booking reference and a description of the incident.
12. Governing law and jurisdiction
These terms are governed by Spanish law. Any dispute that cannot be resolved amicably will be submitted to the courts that correspond under applicable consumer protection regulations.
13. Data protection
Providing the service requires sharing some of the user's data with third parties: with Correos, their name, phone and itinerary, for the transport; with Stripe, the payment details; and with Twilio (WhatsApp) and our email provider, the contact details, to send the booking notices. What data is processed, on what legal basis, who it is shared with, how long it is kept and how to exercise the rights are set out in the Privacy Policy, which the user accepts together with these terms.
